The federal government enacted the Uniformed Services Former Spouses' Protection Act (USFSPA) to govern the way military retirement benefits are calculated and distributed in divorce. The USFSPA calculates and allows for distribution of a former spouse's share of military retirement benefits once the service member reaches retirement eligibility. However, military retirement benefits are only divided if the couple was married at least 10 years while the service member was in active duty.
